THE ART OF USING TRUSTS FOR ENTREPRENEURS

Date: 12 August 2022 from 4:00 PM to 5:00 PM HKT (UTC/GMT +8 hours)

A once-unicorn Chinese video-sharing website that had originally planned to list on NASDAQ with a forecasted valuation of USD1 billion in December 2010, was delayed for eight months with a valuation of 20% lower than forecast. The cause of the delay is rumoured to be the founder’s marriage dispute. Whilst there may be other factors which caused the lower valuation, one thing is certain; the simple use of a trust would have prevented the delay in the company’s listing.

Trusts, although originally developed as a private family arrangement, are a surprisingly useful structure in the commercial world, especially for entrepreneurs and start-ups and during the lifecycle of the business. They combine a high degree of flexibility with strong protections and certainty.
Our presentation will continue our theme of using trusts in business and how they can be used as a powerful tool to help you protect, expand and strengthen your business, particularly in the following ways:

An invaluable pre-IPO risk management tool in case of any issues affecting a business founder
A corporate trustee offers an additional layer of security to an IPO transaction
Trusts can enable the separation of legal ownership of the trust property from the control and economic enjoyment
A highly effective mechanism through which to retain and incentivise key employees

Our specialist trusts team is highly experienced in the use of trusts for business purposes. Trust and Estate Practitioner (TEP) Alan Fong, Key Account Manager at Sovereign Trust (Hong Kong), will provide an overview on how trusts can be used to help entrepreneurs protect and develop their business.
